Please read these Terms of Service ("Terms," "Terms of Service") carefully before using the Quardian mobile application and the website at quardian.ai (the "Service") operated by Quardian AI ("Quardian," "we," "our," or "us").
Your access to and use of the Service is conditioned on your acceptance of and compliance with these Terms. By accessing or using the Service, you agree to be bound by these Terms. If you disagree with any part of the Terms, you may not access the Service.
Quardian is a mobile security application that scans, validates, and threat-assesses machine-readable codes (QR codes, barcodes, and similar formats). The Service provides:
Quardian offers both free features and paid subscription tiers ("Quardian Pro" and "Quardian HIPAA"). Free features are available without payment. Paid features require an active subscription.
Paid subscriptions are billed through the Apple App Store or Google Play Store. By purchasing a subscription, you agree to the pricing and payment terms presented to you at the time of purchase. Subscription fees are charged on a recurring basis (monthly or annually, as selected).
You may cancel your subscription at any time through your App Store or Google Play account settings. Cancellation takes effect at the end of the current billing period. Refund requests are handled by Apple or Google in accordance with their respective refund policies.
We may offer free trial periods for paid features. If you do not cancel before the trial ends, you will be charged the applicable subscription fee. Trial eligibility is determined by the App Store or Google Play.
You agree to use the Service only for lawful purposes and in accordance with these Terms. You agree not to:
The Service and its original content, features, and functionality are and will remain the exclusive property of Quardian AI. The Service is protected by copyright, trademark, patent, and other laws of the United States and foreign countries.
Quardian's continuous post-scan threat monitoring technology is the subject of U.S. Patent Application No. 30/053,383 ("System and Method for Continuous Post-Scan Threat Monitoring of Machine-Readable Codes with Temporal Drift Detection"), assigned to Quardian AI. All rights reserved.
"Quardian," the Quardian logo, and all related names, logos, product and service names, designs, and slogans are trademarks of Quardian AI. You may not use such marks without the prior written permission of Quardian AI.
Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to download, install, and use the application on mobile devices that you own or control, solely for your personal, non-commercial use.
THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. While Quardian employs multiple analysis layers to detect threats in QR codes and barcodes, we do not guarantee that every threat will be detected. No security tool can provide absolute protection. Quardian is a supplementary security measure and should not be your sole defense against QR code threats.
Threat assessments, risk levels (safe, suspicious, dangerous), and warnings are generated algorithmically based on heuristic rules, pattern matching, SSL certificate analysis, and third-party threat intelligence. These assessments may produce false positives (safe content flagged as dangerous) or false negatives (dangerous content not detected). You should exercise your own judgment when interacting with scanned content.
Product information, nutritional data, food safety warnings, and additive analysis retrieved through barcode scanning are sourced from third-party databases (Open Food Facts, UPC Item DB, Open Beauty Facts). Quardian does not independently verify the accuracy of this information. Do not rely solely on this information for dietary, medical, or allergy-related decisions.
Quardian's HIPAA compliance features (biometric lock, audit trail, PHI detection, data retention) are designed to assist healthcare organizations in meeting certain HIPAA requirements. However, use of these features does not, by itself, make your organization HIPAA compliant. You are responsible for conducting your own compliance assessment and implementing appropriate administrative, physical, and technical safeguards as required by HIPAA.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL QUARDIAN AI, ITS DIRECTORS, EMPLOYEES, PARTNERS, AGENTS, SUPPLIERS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:
You agree to defend, indemnify, and hold harmless Quardian AI and its officers, directors, employees, and agents from and against any claims, damages, obligations, losses, liabilities, costs, or debt arising from: (a) your use of the Service; (b) your violation of any term of these Terms; or (c) your violation of any third-party right, including any intellectual property or privacy right.
We may terminate or suspend your access to the Service immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms. Upon termination, your right to use the Service will immediately cease. All provisions of the Terms which by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnity, and limitations of liability.
These Terms shall be governed and construed in accordance with the laws of the United States, without regard to its conflict of law provisions. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts located in the United States.
If any provision of these Terms is held to be unenforceable or invalid, such provision will be changed and interpreted to accomplish the objectives of such provision to the greatest extent possible under applicable law, and the remaining provisions will continue in full force and effect.
The failure of Quardian AI to enforce any right or provision of these Terms will not be considered a waiver of those rights. The waiver of any such right or provision will be effective only if in writing and signed by a duly authorized representative of Quardian AI.
These Terms, together with the Privacy Policy, constitute the entire agreement between you and Quardian AI regarding the use of the Service, superseding any prior agreements between you and Quardian AI.
We reserve the right, at our sole discretion, to modify or replace these Terms at any time. We will provide notice of any material changes by posting the new Terms on this page and updating the "Last Updated" date. Your continued use of the Service after any such changes constitutes your acceptance of the new Terms.
